WhatsApp automation in Europe means using the WhatsApp Business API and an AI agent to answer customers, confirm bookings, send reminders and follow up on WhatsApp, alongside an AI voice agent for phone calls, all within GDPR. Europe is where WhatsApp is most woven into daily life, and also where the rules are most detailed. Get the rules right and Europe is one of the best markets in the world for voice and WhatsApp automation.
This guide covers usage across the UK and the largest EU markets, what GDPR, the ePrivacy rules and the UK's PECR require for WhatsApp messages, what the EU AI Act's transparency obligation means for AI voice agents from August 2026, and a practical flow that respects all of it.
WhatsApp across Europe: the numbers
In much of Europe, WhatsApp is the default way people message each other, and increasingly how they message businesses. Ofcom's Online Nation 2025 report found that 90 percent of online adults in the UK use WhatsApp. In Spain, the competition and markets regulator CNMC found that 94.6 percent of internet users use WhatsApp regularly. Newcom counts 13.8 million WhatsApp users in the Netherlands, 12.1 million of them daily. Médiamétrie measured 50.6 million monthly unique visitors to WhatsApp in France in August 2026.
| Market | Instant messaging use, ages 16–74 (Eurostat 2025) | WhatsApp-specific data point |
|---|---|---|
| Netherlands | 97.7% | 13.8M users aged 15+ (Newcom 2026) |
| Spain | 94.8% | 94.6% of internet users use WhatsApp regularly (CNMC) |
| Italy | 84.3% | No recent primary WhatsApp-only figure |
| Germany | 82.8% | No recent primary WhatsApp-only figure |
| France | 75.4% | 50.6M monthly unique visitors, Aug 2026 (Médiamétrie) |
| EU-27 | 82.3% | |
| United Kingdom | Not in Eurostat | 90% of online adults (Ofcom 2025) |
The Eurostat figures cover all instant messaging apps, not WhatsApp alone, but in these markets WhatsApp is the dominant one.
GDPR and WhatsApp: what businesses need in place
- A lawful basis for each purpose. Answering a customer who messaged you, or confirming a booking they made, can usually rely on the contract or legitimate interests. Promotional messages are different (see the next section).
- Processor contracts. Under Article 28 of GDPR, every time a controller uses a processor there must be a written contract. That covers your WhatsApp automation vendor, and Meta, which acts as your processor for Business API messages under WhatsApp's Business Data Processing Terms, contracting through WhatsApp Ireland Ltd for EU businesses.
- Data location. Meta's Cloud API offers a Local Storage setting per phone number, with Germany, Switzerland and the UK among the options, though message content can be processed internationally for up to 60 minutes before it is stored only in the chosen country. Ask your provider whether it is enabled.
- Transparency and rights. Tell customers how their conversation data is used, keep it no longer than needed, and handle access and erasure requests across calls and chats.
Vaami is GDPR and UK GDPR compliant. Whichever vendor you choose, ask the same questions: who processes the data, where it is stored, how long it is kept and how deletion works across both voice and WhatsApp.
Marketing consent: the ePrivacy rules and the UK's PECR
Service messages and marketing messages are treated very differently in Europe. In its 2024 guidelines on legitimate interest, the European Data Protection Board explains that the ePrivacy rules require prior consent for direct marketing by email, SMS and "other kinds of similar applications", so legitimate interest cannot be relied on. The exception is the so-called soft opt-in: marketing similar products to your existing customers, with an opt-out offered when you collect their details and in every message.
The UK's Privacy and Electronic Communications Regulations (PECR) follow the same logic. The ICO's guidance says electronic mail includes in-app messages and direct messaging on social media, and that purely customer-service messages fall outside the marketing rules until marketing content is added. The Data (Use and Access) Act 2025, which received Royal Assent on 19 June 2025, raised the maximum PECR fine to £17.5 million or 4 percent of global turnover.
Regulators do act on WhatsApp specifically. In 2024 Spain's data protection authority, the AEPD, fined an energy consultancy €5,000 for continuing to send promotional WhatsApp messages after a person asked for their data to be erased.
The EU AI Act's disclosure rule for voice and chat agents
The EU AI Act entered into force on 1 August 2024. Its transparency rules in Article 50 apply from 2 August 2026, and a 2026 amendment package did not delay them. Article 50(1) requires providers to design AI systems that interact directly with people so that those people are informed they are interacting with an AI system, unless it is obvious. Article 50(5) says the information must be given clearly, at the latest at the first interaction.
The European Commission's guidelines on Article 50, published in July 2026, list AI voice assistants and customer-support conversational agents as in scope. For voice and telephony, they recommend an explicit spoken statement at the beginning of the interaction, such as "This is an AI-powered assistant", with reminders during long calls. A tone or sound on its own is not considered sufficient. For WhatsApp, the equivalent is a clear line in the first message. Build both into your scripts before you launch.
The European flow: compliant from the first second
- 01A customer calls a clinic in Manchester or Madrid. The voice agent opens with a clear statement that it is an AI assistant, then books the appointment.
- 02A confirmation goes to WhatsApp as a service message, with the address and a reschedule button. No marketing, so no marketing consent is needed.
- 03The customer replies in the evening. The AI agent answers in the same language and, if asked, says it is an AI.
- 04A reminder goes out before the appointment. If the customer taps "Call me", the voice agent calls with the chat in context and repeats the AI disclosure.
- 05Any offer or promotion goes only to customers with marketing consent or a valid soft opt-in, and always includes an opt-out.
- 06Calls and chats are logged to your CRM under your retention policy, and access or erasure requests cover both channels.
Business API setup, 24/7 replies, service templates and one-tap callbacks.
Languages: one agent, many European customers
European customers expect to be served in their own language, and many businesses serve several. Vaami's 30+ languages include English, Spanish, French and Polish, and the WhatsApp agent replies in the language the customer writes in. If you need German, Italian, Dutch or another language, confirm coverage and test it with your own vocabulary, such as street names, product names and opening hours, before launch.
Where voice + WhatsApp works best in Europe
- Private clinics and dental practices: book by phone, confirm and remind on WhatsApp, and call patients who don't confirm so cancelled slots are refilled.
- Estate agents and lettings: call portal enquiries back quickly, send viewing details on WhatsApp and let applicants rebook in the chat.
- E-commerce and retail: answer order, delivery and returns questions on WhatsApp, and call when a delivery problem needs a conversation.
- Hospitality and travel: send check-in details and directions, answer questions before arrival and handle late changes by phone.
- Automotive and home services: confirm service bookings and arrival windows, and take after-hours calls.
UK GDPR, ICO alignment, TPS and CTPS screening for outbound calls.
Portal lead callback, buyer and tenant qualification, viewing and valuation booking.
European launch checklist
- 01Map each WhatsApp message type to a lawful basis, and separate service messages from marketing.
- 02Sign processor agreements with your automation vendor and review WhatsApp's Business Data Processing Terms.
- 03Decide on data location, including Meta's Local Storage setting for your WhatsApp numbers.
- 04Add an AI disclosure at the start of every call and in the first WhatsApp message.
- 05Collect and record marketing consent, or check soft opt-in conditions, and include an opt-out in every marketing message.
- 06Screen outbound call lists against national do-not-call registers, such as the TPS and CTPS in the UK.
- 07Set retention periods and make sure access and erasure requests cover calls and chats.
